The state land supervision will be based on a risk-oriented approach

The signed Decree of the Government of the Russian Federation of 07.08.2017 No. 943 "On the introduction of changes into certain acts of the Government of the Russian Federation with regard to the improvement of state land supervision "determines, that the Federal Agency for State Registration, Cadastre, and Cartography (Rosreestr) will conduct verification of compliance with the requirements of the land law with a risk-oriented approach.

It is envisaged that, for the purpose of applying a risk-oriented approach, the land plots, used by the legal entities or the Individual Entrepreneurs (for which they are the right holders) shall be referred to one of the risk categories in accordance with the Regulations, approved by the Decree of the RF Government of 17.08.2016 No. 806 (medium, moderate and low risk categories).

The criteria and procedure have been established to categorize land plots as a risk category, as well as the order of changing the assigned category. In particular, the medium risk category includes the land plots, intended for the burial and storage of solid household wastes, placement of cemeteries, garage or housing construction.

Routine inspections will be carried out for the sites, classified as average risk, no more often than once every 4 years, for the sites classified as moderate risk, no more often than once every 5 years (for the sites classified as low risk, no routine checks will be carried out).

The term of execution of scheduled inspections of the use of sites, classified as moderate risk, should not exceed 17 working days.

The Ministry of Economic Development of Russia has been instructed to approve the indicators of the risk of violating mandatory requirements in the implementation of the Rosreestr of state land supervision, which are used to determine the need for unplanned inspections.
