Declaration to creditors on the obligations of the PAO "Tatfondbank"

By the order of the Bank of Russia dated 03.03.2017 No. 542 C 03.03.2017 the license to carry out banking operations was revoked from the credit organization PAO "Tatfondbank".

By the decision of the arbitral tribunal of the Republic of Tatarstan dated 11.04.2017 (date of Declaration of operative part) in the case of A65-5821/2017 PAO "Tatfondbank" is found to be insolvent (bankrupt) and a competitive proceeding was opened concerning it. The functions of the bank's competitive governor are vested in the State corporation, the Deposit Insurance Agency (hereinafter referred to as the agency).

The agency reports that the payments of natural persons unsent from PAO "Tatfondbank" adopted prior to the date of the imposition of the stay (15.12.2016) through the cash department of PAO "Tatfondbank", the online partner remote banking system and the "Tatfondbank" self-service terminals (with the exception of payments made for repayment of credits,) issued in other banks and the replenishment of the Accounts of natural persons opened in other banks are taken into account in the Tatfondbank balance in the accounts 47422 opened broken down to the creditors-payees of legal entities and individual entrepreneurs.

Under the provisions of articles 16.1, 37 of the Russian law dated 07.02.1992 No. 2300-1, "About the protection of consumer rights", payment shall be deemed to be fulfilled from the time the money is paid by the payer to the bank cash department or the money is written off from the payer's account. The  creditor of the PAO "Tatfondbank" obligations, related to the non-transfer of money made in favor of the organizations, is the legal entities and individual entrepreneurs who are the recipients of the funds.

Legal entities and individual enterpreneurs – are recipients  entitled to submit their request to PAO "Tatfondbank" attaching documents, confirming their validity (e.g., registries of unpaid payments, copies of payment orders, receipts, etc.) at any time during the competitive proceeding. Note, that claims made after the closing date of the creditor claims Register (31.07.2017) will be met from the property of the PAO "Tatfondbank", which is left after the claims of creditors included in the creditor's register of claims are satisfied.
