The bill on compensation for violations of intellectual rights has been introduced to the State Duma

The Prime Minister of Russia - Dmitry Medvedev has signed the order on introduction to the State Duma of the draft federal law clarifying the procedure for determining the amount of compensation for infringements of intellectual property rights.

The bill provides that if one action violates the rights for several results of intellectual activity and to the means of individualization, the amount of compensation should be determined by the court for each unlawfully used result. However, if the rights for the relevant results of intellectual activity and to the means of individualization belong to one or more right holders, the total amount of compensation for violation of rights, with account of the nature and consequences of the violation, may be reduced by the court below the limits established by the RF Civil Code , but can not be lower than the minimum amount of compensation for one violation ($ 10,000).

In addition, the bill envisages that during determining the amount of compensation, the court should take into account the repeated violation of intellectual rights.
