The action plan for the clients, not included in the list for getting compensation in case of occurrence of the insured event

The Federal Law No.177-FL dd. 23.12.2003 “On ensuring deposits of physical persons in banks of the Russian Federation” ensures receipt of insurance reimbursement upon occurrence of the insured event. The introduction of the moratorium on satisfaction of creditors’ requirements is also recognized as an insurance case.

On issues relating to payment of insurance compensation, please contact the temporary administration of the bank at the registered address or the state corporation “Agency for deposits insurance”: 109240, Moscow, Vysotskogo str., bld. 4 (hotline: 8-800-200-08-05 (toll-free in Russia).

If your name is not found in the registry of the depositors, you must obtain from the agent bank a written denial of payment.

Next, you should submit to the Agency an application with your disagreement and the additional documents, confirming the grounding of your requirements.

Such documents can be as follows: bank deposit contracts, court resolutions, pay-in slips and account statements, other documents (the Procedure of payment of compensation for deposits, approved by the decision of the Board of the State Corporation "Agency on insurance of deposits" of 3 August, 2006).

In this case, the investor has two options for further actions.

The first option

1. To submit to the Agency an application with disagreement and any additional documents as indicated above.

2. In case of non-inclusion into the register of obligations to depositors to apply to the court in the manner, prescribed by law, with the claim for establishing the composition and size of the relevant requirements, and compensation for deposits subject for payment.

The second option

1. To apply to the Agency or the bank with a written application on making correction to records in accounts. The sample application can be found on the Agency's website (section "Questions and answers" -> "Question 44"). The status of the application also can be found on the website of the Agency for Deposit insurance ("Deposit Insurance" -> "to Know the status of statements of disagreement").

2. After correcting the records to seek reimbursement on the deposit and to receive funds within the insurance sum (less than 1.4 million RUB).

3. Depending on further decisions on the Bank – to submit the claim on inclusion in the register of creditors of the first stage in excess of the indemnity (Article 189.87 of the Federal Law dd. 26.10.2002 № 127-FZ “On insolvency (bankruptcy)”), or to be able to dispose all of your funds in the bank (in case of reorganization of the bank).
