A law on the advantage of small and medium-sized businesses for the purchase of leased movable property was adopted

The State Duma adopted in the third reading a law that extends the pre-emptive right of SMEs to movable property that is in state or municipal ownership. Previously, this right extended only to the purchase of immovable leased property.

In particular, there is a rule on the possibility of alienation for compensation of movable property of a state or municipal unitary enterprise in the order of the pre-emptive right of an SME subject to acquire the said property. At the same time, a small business must meet a number of established requirements.
 
According to the law, movable property on the day of filing an application for redemption by an SME entity must be in its temporary possession and (or) temporary use continuously for one year or more in accordance with the contract, except for cases provided for by law.

It is also provided that the installment period for payment of leased property acquired in the course of exercising the pre-emptive right by SMEs is established accordingly by the regulatory legal act of the Government of the Russian Federation, regional law, municipal legal act and should not be less than five years for real estate and less than three years for movable property.

  The law will come into force on March 1, 2023.
