The meeting of the working group on the implementation of the Action Plan to ensure the sustainable development of the Economy of the Republic of Tatarstan was held at the Ministry of Economy of the Republic of Tatarstan. The members of the working group discussed the changes in the legislation that expand the access of SME to the procurement of state-owned companies and corporations and the amendments to the draft law "On Insolvency (Bankruptcy)".
The Ministry of Finance of the Russian Federation has developed and posted on the federal portal of draft regulatory legal acts within the framework of the implementation of the Address of the President of the Russian Federation, a draft Government resolution providing for changes that expand the access of small and medium-sized businesses to the procurement from state-owned companies and corporations.
The amendments are aimed at providing additional support to SME by increasing the share of purchases by customers under Law No. 223-FZ.
In particular, the Ministry of Finance of Russia offers:
- increase the minimum mandatory share of purchases from SME from 20 to 30 % of the annual volume of customer purchases;
- increase the number of customers who are required to reach this minimum share of purchases. Thus, it is proposed to extend the obligation to all customers under 223-FZ (instead of separate categories of customers, as currently provided for);
- to introduce electronic document flow through a single information system in the field of procurement between the SME Corporation and customers for whom the SME Corporation performs procedures for assessing and monitoring compliance with the established minimum share of purchases from SME.
Also on May 17, the Government of the Russian Federation submitted to the State Duma a bill providing for amendments to the Federal Law "On Insolvency (Bankruptcy)".
The bill is intended to adjust the bankruptcy procedure. The primary goal is to help the entrepreneur save his business.
The new bill will expand the practice of applying rehabilitation mechanisms to legal entities and introduce a new procedure: debt restructuring. It is also proposed to abandon such bankruptcy procedures as supervision, financial recovery and external management, limiting the use of one rehabilitation and one liquidation bankruptcy procedures – debt restructuring and bankruptcy proceedings, respectively.
Thus, instead of the existing four bankruptcy procedures, only two will remain.
In addition, a report of the Leninogorsk Municipal District of the Republic of Tatarstan on the implementation of measures to ensure the development of the economy of the Republic of Tatarstan and reports of ministries on the growth reserves of the Leninogorsk district were heard at the meeting.
