The criteria of referring the controlled objects to risk categories during exercising state control in the field of shared construction have been developed

A relative draft decree of the Government of the Russian Federation "On application of a risk-oriented approach during organization of state control (supervision) in the area of shared construction of dwelling houses and (or) other real estate objects" is undergoing the independent anti-corruption expertise at the Federal portal of draft normative legal acts.

The project proposes to approve the Rules for classification of activity of legal persons to a certain risk category in exercising state control (supervision) in the area of shared construction of dwelling houses and (or) other real estate objects.

According to the project, the risk indicators of possible non-compliance with the mandatory requirements in the implementation of this type of control (supervision) depend on:

- breach of timelines for obligations' fulfillment,

- availablity of non-purpose use of funds belonging to participants of share construction, identified following the results of analysis of quarterly reporting;

-non-compliance with regulations of financial stability;

-administrative offences.

Routine checks of legal persons depending on the risk category are carried out with the following frequency:

-for high risk categories-once per calendar year;

-for category of significant risk-once in 2 years;

-for moderate risk categories-once in 3 years;

-for moderate risk categories-not more than once every 3 years.

The routine checks are not carried out in respect of subjects of state control (supervision), classified as low risk. In addition, the bodies of state control bear the responsibility to maintain reference lists of legal entities whose activities are referred to a risk category.
