The related project of the Regulation of the government of the Russian Federation “About applying the risk-oriented approach when state housing supervision and state licensing supervision organizing in respect of blocks of flats managing”, which was developed by the Ministry of Housing and Building of the Russian Federation, passed a procedure of public hearing on the Federal portal of regulatory acts projects.
This project offers some statements about applying risk-oriented approaches when state housing supervision and state licensing supervision organizing in respect of blocks of flats managing. These statements set criteria of certain risk category concerning activities performing by legal bodies.
According to the project risk markers of possible non-compliance of strong requirements when above mentioned supervision performing depend on:
- the number of effective acts about setting the administrative penalty for persistent violations foreseen by a section of 19.4.1 AOC RF “Impending legal activities of the public officer of the state supervision body”;
- the number of effective acts about setting the administrative penalty for persistent violations, delivered protocols made up by state housing supervision body about administrative violations, except for acts about setting the administrative penalty for persistent violations foreseen by a section of 19.4.1 AOC RF;
- the number of issued instructions to rectify discovered violations of acts;
- the total area of blocks of flats, affiliated to the legal body.
Plan checks of legal bodies depending from the risk category are carried out with following intervals:
- for the high risk category – once a year;
- for a medium risk category – once every other year;
- for a moderate risk category – no more than once every 3 years.
For a low-risk category plan checks are not organized.
For another thing the state control bodies are responsible for managing lists of legal bodies and managers of organizations with the activity of the risk category.
