The State Duma adopted a document in the first reading on introducing changes to the Federal Law “On contract system in the sphere of purchasing goods, works, and services for meeting state and municipal requirements”.

On February 10, 2017 Deputy Minister of Economic Development of RF – Mr. Evgeniy Elin presented to the plenary meeting of the RF State Duma a draft of Federal Law on introducing changes to the Federal Law “On contract system in the sphere of purchasing goods, works, services for meeting state and municipal requirements”.

“The document envisages introduction of changes into part 9 of Article 37 of the Federal Law of April 5, 2013 “On contract system” № 44-FL. According to the draft bill in case of an auction or tender for supply of fuel or separate kinds of goods according to the list approved by the Government the participant of procurement, offering a decrease of price by more than 25 percent, has to confirm with documents the possibility to fulfill this contract at this price”, - specified Deputy Minister of Economic Development of the RF.

In addition he added that this confirmation shall be made by providing a client with the documents, which will be determined by the RF Government in respect of specific kinds of goods. At that the general anti - dumping requirement on provision of the increased by 1, 5 times contract coverage will apply to such participant.

The need of introduction of the indicated changes is conditioned by the fact that the existing similar norm contains law uncertainty. So, in accordance with the applicable norm during procurement of goods, required for normal sustainment, the participant of procurement, who offered the price decreased by more than twenty five percent, has to provide the client with a written substantiation of the offered contract price.

This draft bill is focused at improvement of taking anti-dumping measures during making state procurements.
