Simplified rules for appealing against inspections and other control and supervisory measures scheduled during the moratorium

The Government of the Russian Federation amended Resolution No. 336 dated March 10, 2022, simplifying the rules for appealing against inspections and other control and supervisory measures appointed during the moratorium. The changes are aimed at simplifying the procedure for filing a complaint about a violation of the moratorium on the conduct of control and supervisory activities.

The changes were introduced by Decree of the Government of the Russian Federation No. 1431 dated August 17, 2022 and have already entered into force, with the exception of the rule on the use of an enhanced unqualified electronic signature when signing a complaint, which comes into force on October 1, 2022.

So, a complaint can now be sent through a special service on the public services portal and signed with a simple electronic signature. This procedure applies not only to citizens and individual entrepreneurs, but also to organizations. Previously, such an opportunity was available only for individual entrepreneurs and citizens, while legal entities had to use an enhanced qualified electronic signature.

Housing inspections no longer need to coordinate unscheduled inspections on complaints with the prosecutor's office this year.

Verification of the implementation of instructions to eliminate violations can be carried out not only through an on-site inspection (up to 10 days), but also through an inspection visit (carried out within 1 day). This will reduce the time of interaction between controllers and business. The issuance of prescriptions based on the results of control (supervisory) measures without interaction with the controlled person is not allowed.

It is written that the moratorium does not apply to state control over the exercise by regions of powers in the areas of natural monopolies and state regulation of tariffs.

The rules for the formation and maintenance of a unified register of licenses and a unified register of control (supervisory) activities have also been adjusted. Now all information about permitting activities will be in one place.

Recall that the moratorium on scheduled and unscheduled inspections of small businesses is valid in Russia until the end of 2022. It is designed to save entrepreneurs from unnecessary administrative burden.
