On September 1, 2020, the prosecutor’s office began work on formation of annual plans for scheduled inspections for 2021.
Formation of inspection plans allows you to protect business entities from unjustified and unlawful interference by regulatory authorities in their activities, thereby ensuring the legality of control and supervisory activities.
In accordance with the Procedure for formation by the Prosecutor's Office of an annual consolidated plan for conducting scheduled inspections of legal entities and individual entrepreneurs, approved by the General Prosecutor's Office of the Russian Federation, prosecutors need to assess the compliance of the control bodies with the basic principles of protecting the rights of legal entities, individual entrepreneurs in the exercise of state control (supervision), municipal control. Prosecutors are focused on adhering to a risk-based approach when planning verification activities and the inadmissibility of increasing their number by control authorities.
It should be noted that a five-year ban on inspections of small businesses has expired. In addition, on December 31, 2020, the moratorium on inspections in respect of most business entities established by Decree of the Government of the Russian Federation No. 438 of April 03, 2020 expires.
However, the Russian Government intends to extend the moratorium on scheduled inspections of small and medium-sized businesses until the end of 2021, as well as to limit scheduled inspections from January 1, 2021. This is stated in the current version of the national plan for the economic recovery of the Russian Federation.
