Federal law on obtaining patents in electronic form was adopted

Federal Law No. 217-FZ of July 20, 2020 “On Amendments to Part Four of the Civil Code of the Russian Federation” adopted amendments, thanks to which applicants will be able to obtain patents in electronic form, as well as attach 3D models to materials when registering intellectual property.

The adopted amendments were prepared as part of the implementation of the federal project “Normative Regulation of Digital Environment” of the national program “Digital Economy of the Russian Federation” in order to improve the system of state registration of intellectual property objects, including reducing the examination time and improving its quality.

According to the amendments to the Civil Code of the Russian Federation, titles of protection, with the exception of a patent for a secret invention, will be issued in electronic form, while retaining the possibility for the applicant to obtain them at will on paper.

In addition, applicants will be able to attach their three-dimensional models to the application materials for state registration of intellectual property objects. We are talking about inventions, utility models, industrial designs and trademarks.

The three-dimensional models presented by the applicant in the application materials will be used only when Rospatent examines the claimed results of intellectual activity. 3D models are not published.

The active introduction of digital services and electronic document management is supported by the Ministry of Economy of the Republic. For innovators and inventors, training seminars, consultations on obtaining grant support and registration of protection documents are held.

In order to develop electronic services in the field of intellectual property in the republic, a digital platform “TatPatent” (https://patentrt.ru/), which unites a number of important areas - from design and patent offices to services for creating applications for competitions and grants, as well as assistance in registering intellectual property objects, was created with support of the Ministry of Economy and the State Unitary Enterprise of the Republic of Tatarstan “Tatarstan CSTI”. To date, the possibility of online submission of documents for interaction with the patent office on the basis of the CSTI and preparation of an examination for the issuance of a patent has been implemented on the basis of “TatPatent”.
