A draft law "About the State and Municipal control in the Russian Federation" has been submitted to the Government of the Russian Federation

The project of the federal Law "About the State and Municipal control in the Russian Federation" developed by the MEDT of Russia has been submitted to the Government of the Russian Federation.

In general, this draft law defines:

• - the legal and organizational bases of the control, performed by the executive and local government authorities;
• - common principles of organizing the state and municipal control;
• - the appropriate protection of the citizens' and organizations' rights.

The main innovation of this draft law is the introduction of the risk management system that involves the creation of the department system and integration of this system to the relevant bodies activity. This draft law provides the widest use of different tools to prevent the violation of obligatory requirements and to develop precaution institutes and warnings instead of fines, and addition of measures aided on realization the rights of citizens and organizations to challenge official's actions while carrying out the State and municipal control and its results.

Draft-law also establishes an exhaustive list of all forms of municipal and State control.

It is a reminder that  this draft-law, since 2015, was many times discussed about in the Ministry of Economic Affairrs of Russia, taking into account proposals of the Russian Federation entities. The new version of the document takes into account the proposals of the Republic of Tatarstan.

Today, in the Russian Federation provisions, described in the draft-law, are partially realizing - there are actions to prevent the violation of obligatory requirements and actions to introduce the risk-oriented approach while carrying out the state control, specified in the priority program "Reorganization of means of control and supervision".

In general, the adoption of the draft-law will allow to improve the efficiency and effectiveness of State and Municipal control, while reducing the state and local bodies interference to citizens and organizatios actions.
