The Ministry of Emergency Situations will not punish twice for one violation, the warning will be the main corrective action

The Ministry of Emergency Situations (MES) is recommended to implement risk-oriented approach in the spheres of its supervision, to enhance the role of preventive measures, and the responsibility should not be the main preventive measure of struggling with violations. The MES in particular should not punish twice for one violation, and the warning should become the main corrective action. Such recommendations are contained in the resolution adopted by the results of the All Russia forum of the Open Government, MES and entrepreneurship platform of the party “United Russia” in respect of reforming state control and public discussion of law enforcement practice of the supervisory bodies of MES, which took place in April 2017. Please be reminded that public events on discussing law enforcement practices have been held quarterly since 2017 in the federal power authorities and their territorial subdivisions in the subjects of the Russian Federation. This norm is envisaged by the priority program “The reform of control-supervisory activities” and requirements of the Federal Law of 26.12.2008 №294-FZ “On protection of rights of legal entities and individual entrepreneurs during execution of state control (supervision) and municipal control”. The information on the upcoming events should be placed on the official website of the power authority not later than in two weeks before the events.

The first public discussion of the law enforcement practice of the MES together with business community took place on April 7 in Tula. The State Labor Inspection became the first federal power authority, holding such event in the Republic of Tatarstan. The event took place on April 25, 2017 in the city of Kazan with participation of the President of the Republic of Tatarstan – Mr. Rustam Minnikhanov, the Minister of the Russian Federation – Mr. Mikhail Abyzov, Head of the Federal Service for labor and employment – Mr. Vsevolod Vukolov, control-supervisory bodies of the republic and territorial bodies of the federal power authorities, as well as representatives of public organizations.
