Provisions of drafts of federal laws on change of requirements to the self-regulating organizations and about the state and municipal control (supervision) regarding coordination of the established requirements will be modified

We invite representatives of enterprise community, members of the self-regulating organizations to take part in discussion of changes to the law on the self-regulating organizations (SRO) developed by the Ministry of Economic Development of the Russian Federation regarding their coordination with the bill "About the State and Municipal Control (Supervision) in the Russian Federation".

On the site of the Open Government the protocol of meeting at the Minister of questions "Open Government" Mikhail Abyzov which took place on July 21, 2015, containing instructions about completion of amendments to this law is published.

The Ministry of Economic Development of the Russian Federation recommended to finish the project taking into account the expert opinion regarding work of SRO till September 1, 2015 and to carry out with Advisory council at the Government of the Russian Federation, association of businessmen and the business ombudsman's device public discussion of the project.

The discussed amendments to the law on SRO will allow to unify in all spheres where the legislation enters self-regulation, approaches to regulation, the mechanism of uniform providing with property responsibility and control mechanisms in SRO. At the same time in the expert opinion it is specified insufficient differentiation in the law on SRO of functions of self-regulation and state control, so there is a possibility of duplication of functions. In general experts suggest to record, on the one hand, directly in the Federal law "About the self-regulating organizations" a ban on simultaneous control by the state and SRO, having defined borders and the principles of a complementarity of state control, on the other hand — to specify, in what part the standards developed by SRO replace subordinate standardly legal acts.
