Today, the Federation Council of the Federal Assembly of the Russian Federation approved a law developed by the Ministry of Economic Development of Russia that allows individuals and self-employed citizens to register trademarks without confirming the status of an individual entrepreneur.
Currently, the Civil Code establishes a restriction on the right to obtain a trademark - only legal entities or individual entrepreneurs (IP) can have it. The law also gives the right to register a trademark to the self-employed, since Russians can engage in certain types of business activities without registering as an individual entrepreneur.
In addition, it provides for mandatory registration of a pledge of rights to computer programs registered with Rospatent. It will allow lending to technology companies secured by the rights to their software products. As a rule, in IT companies of small and medium segments, the software product is the basis of the main assets. Employees of such companies can work decentralized, in different regions of the country.
If a software developer in the field, for example, information security, needs additional funds to launch new projects or current activities, he can contact the bank. The rights to such software may be provided as collateral for the loan. Innovations will allow the bank to check the absence of other encumbrances on rights in Rospatent. This will increase the chances of making a decision on the issuance of credit funds.
