The State Duma adopted a law on the right of self-employed to register trademarks

9 June 2022, Thursday

The State Duma adopted in the third, final reading a law allowing the self-employed to register trademarks. After the entry into force of the law, foreign citizens will also be able to register trademarks in Russia without confirming the status of an individual entrepreneur.

Now the Civil Code restricts the right to obtain a trademark - only legal entities or individual entrepreneurs (IP) can possess it. The law will also give the right to register a trademark to the self-employed.

As noted in the explanatory materials, after the entry into force of the law, foreign citizens will also be able to register trademarks in Russia without confirming the status of an individual entrepreneur.

The changes will make it possible to ensure the equality of the legal status of Russian and foreign citizens in terms of their ability to exercise exclusive rights to a trademark.
