The President of Russia signed a law on reducing the administrative burden on medium and small businesses

28 March 2022, Monday

On March 26, the President of Russia signed Federal Law No. 70-FZ on amendments to the Code of Administrative Offenses of the Russian Federation. The law provides for the replacement of a fine with a warning if, as a result of the offense, no harm was caused to either people or the environment, and such an administrative measure is applied to the violator for the first time.

The size of the fine for small and medium-sized businesses has now been reduced to the amount of a fine for individual entrepreneurs for similar violations. Thus, the amount of a fine cannot be more than ½ of the maximum amount and less than ½ of the minimum amount of an administrative fine provided for a legal entity. Currently, the minimum fine for a legal entity is 50,000 rubles.

The law introduces a restriction on the prosecution of a legal entity and an official for the same violation at the same time. Now only one penalty can be assigned per check.

The law introduces a ban on the summation of administrative fines when imposing an administrative penalty for several administrative offenses united by one composition.

The adopted decision will significantly reduce the amount of fines for a number of administrative offenses within the framework of the activities of control (supervisory) bodies.
